Terms of Service

These Terms of Service ("Terms") govern your access to and use of PylonForge(the "Service"), operated by Allocation Point LLC ("Allocation Point LLC", "we", "us", or "our"), available at https://www.pylonforge.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the service

PylonForge lets you build parametric 3D visualization models of utility and telecom site assets (such as wind turbines, monopoles, towers, and related structures) and export those models as Google Earth–compatible KMZ files. The Service also generates supporting spec-sheet documents summarizing the parameters you enter.

2. Professional-use disclaimer

The models, renderings, and exports produced by PylonForge are visualizations only.

They are not engineering drawings, land surveys, or construction documents, and they are not certified, stamped, or suitable for use in regulatory filings, permitting, structural analysis, RF interference studies, or any other compliance purpose. Any dimensions, siting, or clearance information shown by the Service is illustrative and derived solely from the parameters you enter — it is not verified against real-world survey, geotechnical, or regulatory data. You are solely responsible for having all engineering, surveying, legal, and regulatory work performed and certified by appropriately licensed professionals before relying on it for any real-world decision, filing, or construction activity.

3. Accounts

→You must provide accurate information when creating an account and keep your password confidential.
→You are responsible for all activity that occurs under your account.
→Notify us immediately at support@pylonforge.com if you suspect unauthorized use of your account.

4. Acceptable use

You agree not to:

→Use the Service for any unlawful purpose or in violation of any applicable regulation.
→Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
→Interfere with or disrupt the integrity or performance of the Service.
→Reverse engineer, resell, or sublicense the Service except as expressly permitted.
→Upload content you do not have the right to use, or that infringes another party's rights.

5. Subscriptions and billing

→Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) and automatically renew until cancelled.
→You may cancel at any time from your account settings or the billing portal. Cancellation takes effect at the end of your current billing period — you retain access to paid features through that date, and you will not be charged again afterward.
→Fees are exclusive of applicable taxes unless stated otherwise.

6. Intellectual property

→You retain all ownership rights to the project data, parameters, and content you input into the Service, and to the 3D models, KMZ files, and spec sheets generated from it.
→Allocation Point LLC retains all right, title, and interest in and to the Service itself — including its software, geometry engine, design, and underlying technology. Nothing in these Terms grants you any rights to our software beyond the ability to use the Service as intended.

7. Warranty disclaimer

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate, complete, or suitable for any particular purpose (see Section 2).

8. Limitation of liability

To the maximum extent permitted by law, Allocation Point LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. In no event shall our total aggregate liability arising out of or relating to these Terms or the Service exceed the total fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive termination (including Sections 6, 7, 8, and 10) will survive.

10. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, USA.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
